These Terms of Service (“Terms”) govern your access to and use of a mobile application branded and licensed by an independently operated entity that provides audio streams, content, or related services through the app (“Stations”).
The mobile application branded by a participating Station is referred to as the “Station App.” The Station App is built and operated by RadioActive Expectations LLC (“RadioActive,” “we,” “our,” or “us”) on behalf of participating Stations.
The Station App, together with any related websites and services, is collectively referred to as the “Service.”
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under the age of 18, you represent that you have obtained permission from a parent or legal guardian to use the Service.
The Station App provides audio streaming, station-selected content, and community-related information made available through the app.
Content accessible through the Station App may be provided by the Station, by RadioActive, or by third parties, and may include content modules, features, or services that Stations choose to enable, license, or make available to users. Each Station is an independent operator and is primarily responsible for determining which content and features are made available through its Station App.
RadioActive provides the underlying technology and may also offer managed or commissioned content, including standardized content modules or custom content created at the request of a Station. Stations retain discretion over whether such content is included in their Station App. RadioActive does not control, endorse, or guarantee the accuracy, completeness, or appropriateness of Station-provided or third-party content.
From time to time, the Station App may include optional features or offerings (“Optional Features”) that participating Stations may choose to enable or make available to users.

The Service may include weather information, public safety alerts, or community updates sourced from third parties, Stations, or publicly available government data feeds. Such information is provided for convenience only. The Service is not intended to serve as a primary or official emergency notification system. Users should rely on official government agencies, emergency management authorities, and local public safety channels for critical or time-sensitive information. RadioActive does not guarantee the accuracy, completeness, or timeliness of emergency-related information displayed within the Service.
The Service does not currently require in-app purchases to access core functionality. Any future monetization features, if introduced, will be disclosed and implemented in accordance with applicable app store policies.
Some features of the Service may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You retain ownership of any user-generated content you submit through the Service, including text, audio recordings, or other materials. Users should submit only content they have the right to share. By submitting content through the Service, you grant RadioActive a non-exclusive, royalty-free license to host, store, process, transmit, and share such content with the applicable Station for the purpose of operating, delivering, and improving the Service, including moderating, displaying, and distributing such content within the Service.
RadioActive does not control how a Station may review, select, or use user-submitted content. Any use of such content by a Station is determined solely by the Station and may be subject to station-specific policies or permissions.
The Service may include links to external websites or content displayed through embedded web views. RadioActive does not control and is not responsible for the content, accuracy, availability, or practices of third-party sites. Accessing third-party content is done at your own risk.
The Service, including software, design, text, graphics, audio, video, trademarks, and other content provided by RadioActive, is owned by or licensed to RadioActive and is protected by intellectual property laws. Except for rights expressly granted in these Terms, no rights are granted to you in the Service. You may not copy, reproduce, distribute, publicly display, or create derivative works from the Service except as permitted through normal use of the Station App.
You agree not to misuse the Service or attempt to interfere with its operation. You are responsible for activity conducted through accounts or devices under your control, and you agree to notify RadioActive promptly of unauthorized use of your account. Prohibited activities include, but are not limited to:
RadioActive may suspend or terminate access to the Service, block devices or accounts, and take other reasonable measures in response to suspected misuse or interference. RadioActive reserves the right to pursue available legal remedies for damages caused by misuse of the Service.
RadioActive may suspend or terminate access to the Service if we reasonably believe it is necessary to protect the Service, comply with legal obligations, or enforce these Terms. RadioActive reserves the right to block accounts, devices, or network sources associated with misuse of the Service and to pursue available legal remedies for damages resulting from such misuse.
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, RadioActive shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Service, including loss of data, service interruption, or inability to access content.
You agree to indemnify and hold harmless RadioActive Expectations LLC, its affiliates, officers, employees, contractors, and partners, from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Service, violation of these Terms, or violation of applicable law.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of such courts.
RadioActive may update these Terms from time to time. Updated Terms become effective when posted within the Service or on our website, as indicated by the Effective Date. Continued use of the Service after updates constitutes acceptance of the revised Terms.
